By placing an order and completing the payment process through the website, the Buyer shall be deemed to have read, understood, and accepted all terms and provisions of this Agreement voluntarily and without any coercion. Subject of the Agreement<\/strong>
The subject of this Agreement is the provision and delivery of licensed usage rights for digital products ordered electronically by the Buyer through the Novafer3D website, the determination of usage conditions, the regulation of payment processes, and the definition of the rights and obligations of the parties in accordance with applicable consumer protection laws and distance sales regulations. The products offered for sale through Novafer3D do not constitute physical goods and consist entirely of digital content, digital files, licensed design files, 3D models, render materials, texture files, CAD files, and similar digital production assets.<\/p>\n\n\n\n

Nature of the Digital Products Offered for Sale<\/strong>
The products purchased through the Novafer3D website do not grant the user ownership of any physical goods, but only a limited digital usage license under the terms and conditions specified herein. The products offered for sale may include various digital assets such as 3D model files, texture packs, HDRI files, CAD and DWG drawing files, render materials, ready-made scene files, digital design assets, and specially licensed digital content. The Buyer acknowledges and accepts that the purchased product constitutes digital content and that no physical delivery shall be expected.<\/p>\n\n\n\n

Order and Payment Process<\/strong>
The Buyer may place an order by adding selected products to the digital shopping cart through the Novafer3D website. In order for an order to be completed, the payment process must be finalized in full. Payment transactions are processed through secure payment infrastructures provided on the website. No order shall be considered confirmed until payment approval has been successfully received. The Seller reserves the right to temporarily suspend, review, or cancel transactions involving security concerns, unusual order activity, multiple failed payment attempts, identity verification requirements, or suspected abuse.<\/p>\n\n\n\n

Delivery of Digital Products<\/strong>
Purchased digital products are automatically assigned to the Buyer\u2019s account or made accessible through an electronic download link immediately after the payment process has been successfully completed. Delivery may be carried out through downloads via the user dashboard, license access links sent by email, digital content assigned to the user account, or instant digital access links. Physical shipment is not required for delivery to be considered completed. The provision of digital access to the user shall constitute successful delivery of the product.<\/p>\n\n\n\n

Technical Delivery Issues<\/strong>
The Buyer is responsible for first checking their own system in cases of access issues caused by internet connectivity, device incompatibility, antivirus software, browser restrictions, local system errors, or third-party software. However, if a technical issue is determined to originate from Novafer3D, the Buyer may submit a technical support request via info@novafer3d.com. The Seller shall conduct a technical review within a reasonable period and provide the necessary support to resolve the access issue.<\/p>\n\n\n\n

Pricing and Taxation<\/strong>
Unless otherwise stated, all product prices displayed on the Novafer3D website are shown in Turkish Lira or the applicable currency and are determined in accordance with current tax regulations. The Seller reserves the right to change product prices without prior notice based on market conditions, licensing policies, promotional campaigns, technical improvements, product updates, or other commercial requirements. Any price changes shall apply only to new orders and shall not affect orders that have already been completed.<\/p>\n\n\n\n

Right of Withdrawal and Digital Content Exception<\/strong>
The Buyer acknowledges and accepts that the purchased product constitutes digital content delivered instantly, and that the performance of the product begins immediately once digital access is activated following payment. In accordance with the exception provisions applicable to digital content under distance sales regulations, the right of withdrawal cannot be exercised for digital content that is delivered and performed instantly in electronic form once the consumer has provided explicit consent and the performance has begun. By completing the order, the Buyer expressly declares acceptance of these conditions.<\/p>\n\n\n\n

Order Cancellation and Suspicious Transactions<\/strong>
The Seller reserves the right to unilaterally cancel or suspend an order in cases such as failed identity verification, suspicious payment activity, suspected stolen card usage, attempts that may compromise system security, abuse of bulk licensing, the use of bots or automation tools, or a history of license violations. In such cases, where deemed necessary, any refund may be processed in accordance with the procedures of the relevant payment service provider.<\/p>\n\n\n\n

Dispute Resolution and Effective Date<\/strong>
Any disputes arising from this Agreement shall be governed by the laws of the Republic of T\u00fcrkiye. For users acting as consumers, Consumer Arbitration Committees and the relevant Consumer Courts shall have jurisdiction. For commercial users, the Courts and Enforcement Offices of Bursa, T\u00fcrkiye shall have exclusive jurisdiction.
